Revision Date: 10th August 2026
Emergency Medicine Kenya Foundation (EMKF) supports governments and emergency healthcare providers across Kenya to save lives by strengthening the emergency healthcare system through capacity building, knowledge development, advocacy and research.
These Terms of Use (“Terms”) govern access to and use of EMKF’s websites, mobile and web applications, digital platforms, learning services and related features. They form a binding agreement between EMKF and each person or organisation using the Services.
Please read these Terms carefully. They include important clinical and emergency-use limitations, rules for user accounts and acceptable use, and provisions concerning warranties and liability. Nothing in these Terms limits a right or remedy that cannot lawfully be limited.
“These Terms” are between Emergency Medicine Kenya Foundation (“EMKF”, “we”, “us” or “our”) and the individual or legal entity that accesses or uses a Service (“you” or “your”). “Services” include EMKF-controlled websites, Casualty, Ambulensi, learning and training platforms, applications, content, support channels and any related digital feature. “Content” includes text, protocols, guidance, images, videos, software, tools, datasets, messages and other materials made available through the Services. “User Content” means information or material that a user submits, uploads, records, transmits or posts through a Service.
Additional terms may apply to a particular Service, deployment, paid item, research activity, training programme, county or organisational arrangement. If documents conflict, the specific service, deployment, checkout or organisational terms take priority for that subject; these Terms apply to the remaining matters. The EMKF Privacy Policy and any service-specific privacy notice govern Personal Data processing.
You accept these Terms when you click or tap an acceptance control, register an Account, access a restricted feature, download an application or continue using a Service after being given reasonable notice of the Terms. If you do not agree, do not create an Account or use the affected Service.
If you use a Service for an employer, county, health facility, ambulance provider, training institution or other organisation, you confirm that you are authorised to act for that organisation and that both you and the organisation will comply with these Terms and any applicable organisational agreement.
You must be at least eighteen years old and legally capable of entering into these Terms. A person under eighteen may use a publicly available or age-appropriate Service only with the involvement and permission of a parent or lawful guardian, and only where the Service permits it.
Professional, dispatch, administrative or organisational features may be restricted to verified and authorised users. You must hold any licence, registration, qualification, role or permission required for the activity you perform. EMKF may request reasonable evidence of eligibility or authority.
EMKF Services may provide emergency-care information, clinical-reference and decision-support resources, first-aid guidance, ambulance and incident coordination, location and dispatch functionality, training, assessments, certification support, continuing professional development administration, research or programme tools, communications, purchases, donations and related support.
Features differ by Service, location, deployment, user role and partner arrangement. A description is not a guarantee that a feature will always be available or suitable for every user, patient, incident, device or location.
Unless expressly agreed for a particular deployment, EMKF provides digital coordination, information, training or technical support and is not the ambulance operator, healthcare facility, mobile-network operator, payment provider, professional regulator or emergency-response authority.
You must provide accurate, current and complete registration information and keep it updated. You must protect passwords, authentication factors, devices and access tokens; use only the Account and role assigned to you; and not share credentials or allow unauthorised access.
Organisations are responsible for authorising users, assigning appropriate roles, promptly removing access when a role changes or ends, and ensuring their users are trained and supervised. You must notify EMKF promptly at emkf@emkfoundation.org if you suspect credential compromise, unauthorised use, loss of an enabled device or another security incident.
EMKF may use role-based permissions, authentication, audit logs and other proportionate measures to protect the Services, investigate misuse and meet legal or contractual obligations.
Subject to these Terms and any applicable fees, EMKF grants you a limited, revocable, non-exclusive, non-transferable and non-sublicensable right to access and use the Services for their intended personal, professional or authorised organisational purpose.
This licence does not transfer ownership of a Service, software or Content. It ends when these Terms, your Account or your right to use the relevant Service ends. Rights granted under a specific open, Creative Commons or third-party licence remain governed by that licence.
You must use the Services lawfully, safely, honestly and only for their intended purposes. You must not:
EMKF processes Personal Data as described in the EMKF Privacy Policy and any service-specific privacy notice presented for the relevant activity. You must also comply with any data-protection, confidentiality, health-record, research, employment or professional obligations that apply to you.
You may enter, share or access patient, incident, location or other Sensitive Personal Data only when authorised, necessary for the intended function and supported by an appropriate lawful basis. Use the minimum data reasonably required, verify intended recipients and do not place identifiable patient information in public comments, support messages or other inappropriate fields.
Consent is not the only possible lawful basis for emergency or health-data processing. You remain responsible for determining and documenting the lawful authority applicable to your own professional or organisational processing. If you obtain access to information by mistake, stop using it, do not disclose it and report the incident promptly.
Confidential operational, security or partner information must be used only for the authorised purpose and protected against unauthorised access or disclosure. These confidentiality obligations continue after Account closure or termination.
The Services may provide clinical protocols, first-aid information, calculators, timers, checklists, reference material and other decision-support Content. EMKF does not diagnose or treat patients through the Services, and using a Service does not by itself create a clinician-patient relationship between EMKF and a user or patient.
Unless a Service or its store listing expressly identifies the relevant functionality as a regulated medical device, the Service is not a medical device and does not diagnose, treat, cure or prevent any medical condition. Consult a qualified healthcare professional for medical advice, diagnosis or treatment. In an emergency, use the available emergency-response channels and do not delay appropriate care because of the Services.
Where a Service is classified as a regulated medical device, digital health solution, health information system or e-health application, EMKF will obtain and maintain any certification, approval or registration required by applicable law before offering the regulated functionality or within an applicable transitional period. EMKF will comply with applicable health-information management, interoperability, data-quality, security, audit and regulatory change- or breach-notification requirements. EMKF may restrict, suspend or modify affected functionality where required to maintain safety or regulatory compliance.
Content supports, but does not replace, the judgement of an appropriately qualified healthcare professional. Healthcare professionals remain responsible for patient assessment, diagnosis, treatment decisions, medication checks, scope of practice, professional standards, facility procedures, applicable law and escalation when a case exceeds their competence or the Service’s intended use.
Members of the public should use first-aid or emergency information only as general guidance and should seek qualified assistance as soon as possible. Do not delay contacting available emergency services or attending an appropriate healthcare facility because of information or a feature in the Services.
Clinical information can become outdated or may not fit an individual patient, resource setting or local protocol. Check the displayed version, update status, contraindications, medicine information, local requirements and the patient’s circumstances before relying on Content. Where urgent circumstances prevent full verification, act within your competence and applicable emergency-care standards.
Ambulensi and related features may support incident intake, dispatch, location, routing, communication, response tracking, facility coordination, handover, audit and system improvement. They assist coordination but do not guarantee that an emergency call will connect, that an ambulance or responder will be available, that a stated response time will be achieved, or that a particular destination or outcome will result.
Network, power, device, map, positioning, integration and third-party data failures may affect accuracy or availability. Users must use available backup communication and dispatch procedures whenever a Service is unavailable, delayed, incomplete or inconsistent with the situation.
Authorised operational users must:
Do not rely on Ambulensi as the only means of obtaining emergency assistance unless the responsible authority has expressly designated it for that purpose and communicated appropriate contingency procedures.
Casualty and other learning Services may provide protocols, courses, quizzes, webinars, assessments, learning records and tools for clinical or first-aid support. Access to educational Content does not itself confer a professional qualification, licence, employment right, authority to practise or guaranteed competence.
You must complete assessments honestly and must not impersonate another participant, share restricted assessment content, falsify attendance or results, or circumvent assessment controls. EMKF may withhold, revoke or correct a certificate, record or result where requirements were not met, information was inaccurate or misconduct occurred, subject to applicable programme rules and fair review.
A certificate or continuing professional development record is issued only when the stated completion, identity, assessment, attendance, payment and verification requirements are met. Recognition or award of professional development points remains subject to the relevant regulator, professional body or accrediting institution and any conditions stated for the programme.
Where a Service offers paid certification, professional-development processing, products, events, training, subscriptions or other items, the description, price, taxes, payment method and material conditions should be shown before payment. You authorise the payment provider to process the transaction and must provide accurate billing information.
Refunds, cancellations, transfers and replacements are governed by the terms displayed for the specific transaction and applicable law. Nothing in these Terms creates a blanket exclusion of a refund or other consumer remedy that is required by law. A donation is voluntary and is not payment for a guaranteed service or outcome unless EMKF states otherwise.
EMKF may correct an obvious pricing or description error before fulfilment and will provide an appropriate refund where payment has been taken and fulfilment cannot lawfully proceed.
When a purchase is made within a mobile application, EMKF will use Apple In-App Purchase, Google Play’s billing system or another payment method only where the applicable store rules permit it. Digital Content, subscriptions or application functionality will not be unlocked through a prohibited alternative payment mechanism. Transactions for physical goods, transportation, regulated clinical services or other categories may use a different permitted method where the applicable store rules require or allow it.
Before you confirm an in-app subscription, the purchase screen will clearly state the subscription benefits, total price, billing period, whether it renews automatically, any free-trial or introductory period, the price after that period and how to manage or cancel. Store-managed subscriptions renew and are charged through your store account until cancelled in accordance with the store’s process. The application will provide a reasonably accessible route to manage or cancel the subscription and, where applicable, restore eligible purchases.
Cancellation normally prevents future renewal but does not necessarily create a refund for the current billing period. Refunds and continued access after cancellation are governed by the applicable store rules, the transaction-specific terms and mandatory law. Removing the application or deleting an EMKF Account does not by itself cancel a store-managed subscription, and subscription cancellation is not a condition for requesting Account deletion.
Donations offered through a mobile application will not purchase or unlock digital Content or application functionality and will be made available only through a method and flow permitted by the applicable app-store rules and law. Where store approval or a specified payment mechanism is required for in-app fundraising, EMKF will use that mechanism.
You retain ownership of User Content that you are entitled to submit. You grant EMKF a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, transmit and display that User Content only as reasonably necessary to operate, secure, support, improve or lawfully administer the relevant Service and relationship. This licence is subject to the EMKF Privacy Policy and ends when the content is no longer reasonably required, except for lawful retention, backups, de-identified information and rights already granted to other users through an authorised feature.
You confirm that you have the rights, permissions and lawful authority needed to submit User Content and that it is accurate where accuracy is material. Do not submit confidential or identifiable information through a public or feedback channel.
EMKF may moderate, restrict, preserve or remove User Content where reasonably necessary to enforce these Terms, protect people or systems, comply with law, address a complaint or maintain the intended purpose of a Service. EMKF is not obliged to publish or retain public comments.
If you provide ideas or feedback that do not contain Personal Data or confidential information, EMKF may use them without restriction or payment to improve its work and Services.
Where a consumer-facing feature allows users to publish User Content or interact with other users, EMKF will apply reasonable filtering or review measures appropriate to that feature, provide a mechanism to report objectionable content, respond to reports within a reasonable period and enable users to block abusive users from the consumer-facing interaction. You must use those controls responsibly and may also contact EMKF using section 26. Emergency or regulated operational communications may be preserved, escalated or restricted instead of being hidden where safety, legal, clinical or audit obligations require it.
The Services, software, design, databases, branding, trademarks, logos and Content are owned by EMKF or its licensors and are protected by applicable intellectual-property law. All rights not expressly granted are reserved.
Unless particular Content displays a Creative Commons, open-source or other licence, you may view and use it only within the licence in section 6. A displayed licence governs the identified Content only; it does not automatically apply to software, branding, Personal Data, third-party material or other Content.
You must retain attribution, copyright, licence and proprietary notices. You may not imply EMKF endorsement or use EMKF names, marks or branding without written permission. If you believe a Service infringes your rights, contact EMKF with identification of the work, the affected material, your authority and sufficient information for review.
A Service may link to, integrate with or depend on app stores, maps, telecommunications, payment, hosting, social-media, health, government or other third-party services. Their separate terms and privacy notices may apply to their independent processing and services.
A link or integration does not by itself mean EMKF endorses the third party. EMKF is not responsible for independent third-party content, decisions, availability or acts, but this does not remove any responsibility EMKF has under law for selecting, instructing or overseeing a provider acting on EMKF’s behalf.
Applications are licensed, not sold. Subject to these Terms and any required payment, EMKF grants you a limited, personal or authorised-professional, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use an application on devices that you own or control, solely for its intended purpose and as permitted by the applicable app-store, device, operating-system, telecommunications and third-party-service terms.
For an application obtained through the Apple App Store, these Terms are between you and EMKF, not Apple. EMKF is solely responsible for the application and its Content. Unless EMKF supplies a custom end-user licence agreement through App Store Connect, Apple’s Standard Licensed Application End User License Agreement applies to the licensed application. Where these Terms operate as or form part of a custom end-user licence agreement, the Apple-specific provisions in this section apply.
The licence for an Apple-distributed application is limited to a non-transferable licence to use it on Apple-branded products that you own or control and as permitted by the applicable Apple usage rules, including permitted access through Family Sharing or volume purchasing. You must comply with applicable third-party agreements when using the application.
EMKF, not Apple, is responsible for maintenance and support, any product warranties that cannot lawfully be excluded, and claims relating to the application, including product-liability, legal or regulatory compliance, consumer-protection, privacy and intellectual-property claims. If the application fails to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price paid for the application; to the maximum extent permitted by law, Apple has no other warranty obligation, and EMKF is responsible for any remaining claim, loss, liability, damage, cost or expense attributable to that failure.
Apple and its subsidiaries are third-party beneficiaries of these Terms as they apply to an Apple-distributed application and, upon your acceptance, may enforce them against you. You represent that you are not located in a country subject to a United States Government embargo or designated by that Government as supporting terrorism and are not listed on a United States Government prohibited or restricted-party list. You must not export, re-export or use the application contrary to applicable export-control or sanctions laws.
For an application obtained through Google Play, these Terms are between you and EMKF, not Google. The licence permits use on compatible Android devices and accounts that you own or control, subject to Google Play’s applicable terms and usage rules. EMKF is responsible for the application, its Content, maintenance, support and claims relating to it, except for billing, refunds or other matters that Google expressly administers under its own terms or applicable law. If these Terms conflict with mandatory Google Play rules concerning acquisition, licensing, billing, subscription management or refunds, those rules control only for that store-administered matter.
EMKF may release corrections, security patches, new versions or feature updates. You should install or synchronise required updates promptly. An outdated application or offline device may display previously downloaded Content, status or data and may not reflect later clinical, operational, legal or security changes.
Where the Service identifies the last update or version, users must consider it before relying on the Content. EMKF may restrict an outdated or insecure version where reasonably necessary to protect users, patients, partners or systems.
EMKF aims to provide reliable Services but does not promise uninterrupted, error-free or universal availability. Access may be affected by maintenance, security measures, connectivity, device compatibility, partner systems, emergencies and events beyond reasonable control.
EMKF may add, modify, suspend or discontinue a feature. Where a change materially affects a paid Service or an organisational deployment, EMKF will give reasonable notice where practicable and honour applicable contractual and statutory rights. Emergency or security changes may take effect immediately.
Support channels and target response times may be described in a separate service-level or organisational agreement. General contact details do not create a guaranteed response time.
EMKF may restrict, suspend or terminate access where reasonably necessary because of:
Where circumstances allow, EMKF will give notice and a reasonable opportunity to address a remediable issue. Immediate action may be taken where delay could create material harm, unlawful processing, security compromise or obstruction of emergency operations.
You may stop using a Service and request Account closure. Closure does not automatically delete records that must be retained under law, contract, clinical, training, audit, safety or dispute requirements. Provisions concerning intellectual property, confidentiality, accrued payments, liability, disputes and other terms intended to survive will continue after termination.
If a mobile application allows you to create an Account, it will provide a readily discoverable in-app option to request deletion of the Account and associated data. You may also submit the request without reinstalling the application through the public deletion resource linked from the relevant app-store listing. EMKF will verify and process a valid request as described in the Account and app-data deletion section of the EMKF Privacy Policy. Temporary deactivation, disabling or freezing is not Account deletion.
Account closure, Personal Data deletion and cancellation of an Apple App Store or Google Play subscription are separate actions. Deleting an Account or removing an application does not automatically cancel a store-managed subscription; you must manage that subscription through the relevant store. EMKF will not require subscription cancellation as a condition for submitting an Account-deletion request, although accrued and lawful payment obligations remain enforceable.
To the extent permitted by law, the Services and Content are provided on an “as available” basis. EMKF does not warrant that every Service will be uninterrupted, completely secure, free from all errors, compatible with every device, or accurate for every patient, incident or context.
EMKF will exercise the care and skill required by applicable law and any express written commitment. Nothing in these Terms excludes statutory guarantees, consumer rights, professional duties or other warranties that cannot lawfully be excluded.
To the fullest extent permitted by law, EMKF is not liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable, or for loss caused solely by an independent third party or an event beyond EMKF’s reasonable control.
EMKF is not responsible for a user’s unauthorised access, false or incomplete information, failure to follow clinical or operational judgement, unsafe device use, failure to use an available contingency procedure, or use outside the intended purpose or authorised role, except to the extent that EMKF caused or contributed to the loss and liability cannot lawfully be excluded.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any death, personal injury, statutory duty, consumer right or other liability that applicable law does not permit the parties to exclude or limit.
To the extent permitted by law, you and any organisation on whose behalf you use a Service will be responsible for a third-party claim, loss or reasonable cost arising from your unlawful or wilful misuse of the Services, material breach of these Terms, infringement of another person’s rights, or submission of User Content without the required authority.
This responsibility does not apply to the extent a claim was caused by EMKF’s breach, negligence or unlawful act. EMKF will give reasonable notice of a covered claim and will not settle it in a way that imposes an admission or non-monetary obligation on you without reasonable consultation.
EMKF may update these Terms to reflect changes in the Services, law, security risks, organisational arrangements or business operations. The current approved version and effective date will be displayed with the Terms.
For a material change, EMKF will give reasonable advance notice through the relevant Service, website, email, application notification or another appropriate channel, unless an urgent legal, safety or security reason requires earlier effect. Changes will not retrospectively remove accrued rights.
If you do not agree to revised Terms, stop using the affected Service before the revised Terms take effect and, where applicable, close your Account. Continued use after the effective date constitutes acceptance where permitted by law.
These Terms and the use of the Services are governed by the laws of Kenya. Before starting court proceedings, the parties should attempt in good faith to resolve a dispute by giving the other party sufficient details and a reasonable opportunity to respond, unless urgent relief is required.
If the dispute is not resolved, the courts of Kenya have jurisdiction, subject to any mandatory consumer, employment, data-protection or other legal forum. Nothing in these Terms shortens a statutory limitation period or prevents a person from approaching a regulator or exercising a non-excludable remedy.
If a provision is unlawful, invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. A delay in enforcing a provision is not a waiver. A waiver must be explicit and applies only to the matter for which it is given.
You may not transfer your Account or rights under these Terms without EMKF’s written permission. EMKF may transfer its rights and obligations as part of a lawful restructuring or transfer of a Service, provided this does not reduce non-excludable rights and affected users receive notice where required.
These Terms, together with applicable specific terms and organisational agreements, constitute the agreement governing use of the Services. They do not create a partnership, agency, employment or fiduciary relationship between you and EMKF. A person who is not a party has no right to enforce these Terms except where applicable law expressly provides otherwise.
